Trump Challenges California on Transgender Parental Notification

On Thursday, the Trump administration declared that California’s newly enacted law, designed to protect transgender students from being outed to their parents without consent, violates federal regulations.

This announcement signals a looming legal confrontation over one of the most contentious topics in education and places a significant state law, considered a milestone in transgender rights, at potential risk.

The decision may bolster conservative school boards and parental rights activists both within California and nationwide, who have resisted policies from progressive educators and lawmakers aiming to affirm transgender identities.

California’s Safety Act, which became law when Governor Gavin Newsom, a Democrat, signed it in July, officially took effect on January 1. It prohibits school boards from mandating that school staff inform parents when a student requests to use a different name or pronoun. The law was introduced in response to more than a dozen conservative-leaning school boards attempting to enforce parental notification requirements.

Democratic lawmakers have opposed such disclosure mandates, arguing that they amount to “forced outing,” which could jeopardize students’ well-being. The law explicitly states, “The decision of when and to whom to disclose an LGBTQ+ identity is deeply personal, affecting health, safety, and critical relationships. Every LGBTQ+ person has the right to make that choice for themselves.”

Conversely, Republican leaders contend that parental notification is a fundamental parental right. On Thursday, the Trump administration cited the Family Educational Rights and Privacy Act (FERPA), a federal law granting parents access to their children’s educational records, as grounds for challenging California’s policy.

“Teachers and school counselors should not be the ones guiding minors on significant matters regarding their sexual identity and mental health,” Education Secretary Linda McMahon stated. “That responsibility and privilege belong to a parent or a trusted loved one.”

While California’s law does not prohibit discussions between school staff and parents about gender identity, it does prevent schools from implementing policies that require such disclosure.

The federal probe into California’s public school system—the largest in the nation and based in one of the country’s most progressive states—represents an assertive move by the Department of Education, an agency President Trump has previously vowed to dismantle.

By invoking FERPA to challenge an entire state, the administration is taking an unprecedented legal approach. Traditionally, FERPA enforcement falls under the Education Department’s Student Privacy Policy Office. Most of the department’s high-profile investigations focus on anti-discrimination claims and are handled by the Office for Civil Rights. The administration warned that schools found in violation of FERPA could face the loss of federal funding.

“This interpretation of FERPA is highly unusual,” said Amelia Vance, president of the Public Interest Privacy Center, a nonprofit organization specializing in privacy rights. She explained that while FERPA generally allows parents to request access to their children’s educational information, it does not explicitly require schools to proactively disclose personal student details.

At the same time, Vance noted that FERPA does not prevent states from enacting parental notification laws. Several Republican-controlled states have already passed such legislation.

California Democrats have been vocal in opposing parental notification mandates.

In a recent podcast interview with conservative youth leader Charlie Kirk, Governor Newsom defended the state’s policy, arguing that it allows teachers “the freedom not to snitch.” When Kirk challenged him about the law, asserting that it prevents schools from informing parents if their child is transgender, Newsom responded, “Not true. They can. They just can’t be fired for choosing not to.”

However, during the same interview, Newsom broke from other Democratic leaders by stating that it was “deeply unfair” for transgender athletes to compete in women’s sports.

Izzy Gardon, Newsom’s spokesperson, reaffirmed the governor’s commitment to student safety and the protection of the transgender community, emphasizing that they are under “relentless attack” from the Trump administration.

California’s Education Department leaders pushed back against the administration’s assertion that state law conflicts with FERPA, pointing out that parents can still request access to their child’s records.

State Superintendent Tony Thurmond, a Democrat, issued a statement expressing concern over policies that forcibly out LGBTQ+ students. “Many students and families have told me about the harm caused by forced outing policies,” he said. “To our LGBTQ+ youth and families, know this: You are seen, you are protected, and you are loved.”

California Attorney General Rob Bonta dismissed the federal investigation’s impact on the state’s stance, reaffirming his willingness to sue school districts that violate state law. He also argued that instances of schools withholding gender identity information from parents are “very rare.”

“This is a matter of safety—physical safety, emotional well-being, and mental health,” Bonta stated. “Should a teacher be forced to put a child in harm’s way?”

Parental notification regarding gender identity has become one of the most divisive education policy debates, both in private households and on the national political stage.

California’s Safety Act has also drawn the attention of Tesla CEO Elon Musk, a major Trump donor and a leading figure in the administration’s government efficiency initiatives. Musk, who has an estranged transgender daughter, publicly condemned the law, calling it “the final straw” in his decision to move SpaceX’s headquarters from California to Texas.

The issue has been a focal point for the conservative parental rights movement, which gained momentum during and after the COVID-19 pandemic.

A conservative legal organization, the Liberty Justice Center, welcomed the Trump administration’s involvement. The group is currently representing the Chino Valley Unified School District in a lawsuit against California over Assembly Bill 1955, the Safety Act’s official designation.

“We are pleased to see the federal government taking action,” said Emily Rae, an attorney with the Liberty Justice Center. “Their stance aligns with our position that AB 1955 and California’s education policies infringe on parental rights, violate the Constitution, and contradict federal law.”

For educators and school counselors, the situation remains complex. They must navigate the delicate balance between ensuring students feel safe and supported while also acknowledging that family involvement is often crucial for a child’s well-being.

There are also concerns about protecting students from potential abuse or neglect, as some fear that parental reactions to gender identity disclosures could lead to harm. Professional standards from the American School Counselor Association emphasize the need for family engagement but also stress the importance of affirming students’ gender identities, names, and pronouns—even when parents are unaware.

California Assemblyman Chris Ward, who authored the law, expressed confidence in its legal standing.

“Forcing school officials to disclose a student’s gender identity without their consent contradicts the U.S. Constitution,” Ward stated. “It is a violation of privacy, morally intrusive, and inconsistent with overwhelming mental health research.”

Transgender rights have been a key focus of the Trump administration, though prior efforts related to K-12 education have primarily targeted Title IX regulations. Past investigations included scrutinizing Denver Public Schools for converting a girls’ restroom into an all-gender facility and reviewing Maine’s policies allowing transgender athletes to compete on female sports teams.

President Trump also signed an executive order threatening to withhold federal funding from schools that recognize transgender identities. However, his ability to enforce such measures is constrained, as Congress controls most K-12 education funding, which accounts for only about 10% of school budgets nationwide.
